Will Barack Obama appoint an atheist to the Supreme Court?
Supreme Court Justice John Paul Stevens will be retiring and Nation magazine contributor Marc Cooper argues that it’s time to nominate a nonbeliever to the Supreme Court.
Given that there are currently six Catholics and two Jews, and one Protestant (Stevens), the chance that the new nominee is an atheist is slim. President Obama will feel pressure to elect another Protestant.
However, as Cooper points out, nonbelievers would be underrepresented even if an atheist replaced Justice Stevens. There is 1 nonbeliever for every 6 believers and the Supreme Court ratio would be 1 to 8 if Obama elected an atheist Supreme Court Justice.
What difference would it make?
For one, we would see less appeals to religion in the interpretation of the Constitution and more appeals to reason.
Any concurring or dissenting opinions would be met with extreme scrutiny by theists. It would demystify atheism to a lot of people, giving them insight into the mind of an atheist.
